Equipment Warranty Agreement
Nanohydrotherapy Tubs & Portable Units
This Equipment Warranty Agreement (this “Warranty”) is extended by Life’s Abundance Creation Works Foundation (the “Foundation,” “we,” or “us”) to the private member identified in the member record (the “Member” or “you”) in connection with the nanohydrotherapy equipment supplied to the Member through the Foundation’s private member association. This Warranty is a private agreement between the Foundation and the Member and is not a public offering. It is provided as a benefit of membership and is subject to the terms, conditions, and limitations set forth herein.
01Warranty Overview
This Warranty provides comprehensive coverage for your equipment, safeguarding its performance and reliability throughout the coverage term. Coverage is provided under a single, unified tier:
Two (2)-Year Standard Warranty
The Foundation warrants the full unit — including all mechanical, electrical, filtration, and gas-delivery systems — to be free from defects in materials and workmanship under normal use and service for a period of twenty-four (24) months from the original date of delivery to the Member (the “Warranty Term”).
Should any covered component be found defective in materials or workmanship during the Warranty Term, the Foundation will, at its sole discretion, repair or replace the affected component, or the equipment, at no charge for parts or labor, in accordance with the terms below.
02What Is Covered
Subject to the exclusions in Section 4, the following components are included under this Warranty for both the nanohydrotherapy tubs and the portable units:
- The Unit — Chassis & Structure. The main chassis, tub shell, housing, and structural integrity of the Naneau Nanohydrotherapy Portable Unit and/or the nanohydrotherapy tub.
- Nano Gas Delivery System. The plasma-activated nano/micro-bubble generation module, gas infusion assembly, and associated delivery components.
- Oxygen Systems. The internal medical-grade oxygen concentrator and integrated oxygen componentry.
- Filtration & Distribution. The FSF Biodynamic Whole House cartridge filter housing, hose systems, manifolds, and pumps.
- Electrical & Control Systems. Control boards, wiring harnesses, sensors, and the user-interface controls.
- Parts & Labor. All parts and labor reasonably required to rectify verified defects in materials or workmanship.
03Annual Warranty Renewal
Upon expiration of the Two (2)-Year Standard Warranty, coverage may be extended on an annual basis at the Member’s option. Annual renewal is available for a renewal fee, which will be quoted by the Foundation at the time of renewal and may vary by unit type, condition, and service history.
- Requesting Renewal. Renewal must be requested in writing before the then-current coverage term expires. Lapsed coverage may be reinstated only at the Foundation’s discretion and may require inspection or servicing prior to reinstatement.
- Pre-Renewal Inspection. The Foundation reserves the right to inspect the equipment — or to require proof of proper maintenance — as a condition of renewal.
- Terms of Renewed Coverage. Each renewed term continues the same scope of coverage described in Section 2 and remains subject to all terms, conditions, and exclusions of this Warranty, including any updates in effect at the time of renewal.
- No Obligation to Renew. Renewal is offered at the Foundation’s discretion and is not guaranteed. Payment of the renewal fee is required to activate each successive term.
04Exclusions
This Warranty does not cover, and the Foundation shall have no obligation with respect to:
- Damage. Damage resulting from misuse, abuse, neglect, accidental impact, dropping, improper installation, or operation outside the equipment’s intended purpose or published guidelines.
- Unauthorized Alterations. Any unauthorized repairs, servicing, tampering, or third-party modifications to the equipment or its components.
- Routine Maintenance & Consumables. Filters, cartridges, gaskets, seals, and other consumable or wear items, and the routine maintenance required to keep the equipment in proper working order.
- Water-Quality Damage. Scaling, corrosion, mineral fouling, or contamination arising from source-water conditions or from failure to perform required maintenance.
- Cosmetic Wear. Ordinary cosmetic wear, discoloration, or surface marks that do not affect function.
- External Causes. Power surges, electrical faults external to the unit, improper voltage, fire, flood, freezing, or other environmental or force-majeure events.
- Transfer & Relocation. Damage arising from unauthorized transport, relocation, or transfer of the equipment to a non-member.
05How to Make a Warranty Claim
- Notice. Notify the Foundation in writing promptly upon discovering a suspected defect, and in all cases before the coverage term expires.
- Documentation. Provide proof of membership, the unit’s serial or identification number, the date of delivery, and a description of the issue. Photographs or video may be requested.
- Verification & Authorization. The Foundation will review the claim and, if warranted, issue authorization for repair or replacement. Work performed without prior authorization is not covered.
- Remedy. The Member’s sole and exclusive remedy under this Warranty is the repair or replacement of the covered component or equipment, at the Foundation’s discretion.
06Limitation of Liability
To the fullest extent permitted by law, the Foundation’s liability under this Warranty is limited to the repair or replacement of covered components as described herein. The Foundation shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of use, arising out of or relating to the equipment or this Warranty. This Warranty is the complete and exclusive statement of the Foundation’s warranty obligations and supersedes any prior representations. No agent, dealer, or representative is authorized to modify this Warranty or to make any additional warranty on the Foundation’s behalf.
07General Provisions
- Private Agreement. This Warranty is a private contract within the Foundation’s member association and is non-transferable except with the Foundation’s prior written consent.
- Entire Agreement. This Warranty constitutes the entire agreement between the parties regarding warranty coverage of the equipment and may be amended only in writing by the Foundation.
- Severability. If any provision of this Warranty is held unenforceable, the remaining provisions shall continue in full force and effect.
08Acceptance of Terms
By making a donation to Life’s Abundance Creation Works Foundation for the equipment and accepting delivery of the product — whether completed through the Foundation’s website, in person, or by other means — the Member acknowledges having read and understood this Warranty and agrees to be bound by all terms, conditions, and limitations expressed herein. Completion of the online donation and acceptance of delivery constitutes the Member’s electronic acceptance of this Agreement.
